    Default Standing timber

    So the power company asked, and we agreed, to sell them an expansion of their existing easement across our property. They have flagged some really nice sawtimber sized pines, and some big hardwoods as well for removal. Is there anyone out there that will come in with a portable sawmill and saw it up? Any other options other than having it rot on the ground, or giving it to Dominion?

    I see your location says Columbia. Is said property trees are removed from in Columbia?

    I think you'll be hard pressed to find anyone with a portable sawmill to come by for a few trees. Not saying it's impossible depending on your area.

    The Power Company "should" and "will" pay for the standing timber. I have appraised numerous strips for expanding ROW and normally they pay FMV and they remove the timber off the ROW.

    2th is correct. If you've already agreed to sell @ X price that included the timber.

    Not necessarily…..

    If they bought it fee simple (which I would be willing to bet they did not) the. It’s theirs. If they bought a “ROW” then it all depends on the wording of the easement deed which we haven’t been made privy to.

    One thing you can count on around here is a blizzard of unsolicited advice. We are quite happy with the price we got, thank you.
    Its not that much timber. Maybe 8 pines, tall straight, few limbs, saw sized. They're not taking them. If its doable, I'd like to have them milled. If you have an idea, and would be willing to share, I'd appreciate it. If you feel the need to lecture about whether we negotiated properly, spare me.

    and you didnt say it was 8 trees.

    and no I dont see any portable sawmill willing to come out for 8 pine trees but you dont like that answer. you can certainly take the trees to them but once again thats been said and you didnt like it
